President’s New Executive Order Offers Immigrants Permanent Residency

President Biden announced that the Department of Homeland Security will take steps to ensure that U.S. citizens with noncitizen spouses and children can keep their families together and help pave their path to permanent residency. This new process will assist certain noncitizen spouses and children in applying for lawful permanent residence— a status for which they are already eligible— without having to leave the country. These actions aim to promote family unity and bolster our economy, providing significant benefits to the nation and helping U.S. citizens and family members who are noncitizens stay together.

Eligibility to Apply for Permanent Residency

Eligibility is for noncitizens who resided in the United States for 10 years or more as of June 17, 2024, and be married legally to a U.S. citizen, while meeting all applicable legal requirements. On average, those who qualify have resided in the U.S. for 23 years. Approved applicants, assessed on a case-by-case basis by DHS, will have a three-year period to apply to become permanent residents. They can stay with their families in the United States and work for up to three years. This policy will apply to all eligible married couples.

This action protects around 500,000 spouses of U.S. citizens and 50,000 noncitizen children under 21 whose parent is married to a U.S. citizen.

The new policy permits individuals, including DACA recipients and other Dreamers, who have graduated from accredited U.S. institutions of higher education and received job offers from U.S. employers in their field of study, to expedite the work visa application process. Acknowledging the national benefit of retaining educated talent, the Administration is implementing measures to streamline the employment visa procedure for college graduates with high-skilled job offers, encompassing DACA recipients and other Dreamers.
