Fresno Prepares For More Bad Weather

Torem & Associates

According to ABC30 Action News, crews in Fresno were preparing for another round of storms headed for Central California. At least 180 employees worked hard to fill potholes and clear drains at ponding basins and along streets throughout Fresno. One of the biggest issues was trying to repair potholes as soon as possible. Crews were working to repair as many potholes as possible. Another major worry was the high risk of downed trees throughout the City of Fresno. City officials assured residents they were prepared for major flooding.

Road Hazards and Poor Road Conditions

The recent storms highlight the dangers of driving during poor weather conditions. Driver must deal with many things in addition to the slick condition of roads. Winds create an additional driving hazard that can contribute to an accident. Potholes and other road hazards, such as downed trees and other debris, can contribute to a car accident. Drivers must take extra precautions when driving in adverse conditions.

Who Is at Fault for An Accident Caused by A Pothole?

Potholes and other road debris can cause a driver to lose control of the vehicle and crash into another vehicle, pedestrian, or bicyclist. When this happens, is the driver responsible for the damages caused by the accident?

As with any other car accident, you must prove that the driver caused the accident that resulted in your injury before you can receive compensation from that driver. In many cases, this means you must prove that the driver was somehow negligent. While there may be a few car crashes that are true “accidents” where neither driver did anything wrong that caused the crash, most car accidents are the result of driver error.

Examples of conduct that may make a driver responsible for damages for a car accident caused by a pothole include:

  • Speeding or reckless driving
  • Driving under the influence of drugs or alcohol
  • Distracted driving
  • Fatigued or drowsy driving
  • Following too closely

In each situation, the pothole may have contributed to the cause of the accident, but the driver was also negligent. If you can prove the driver was negligent, you should be entitled to recover compensation for your damages. Common damages you may be entitled to receive compensation for in a car accident claim include:

  • Past and future medical bills
  • Past and future loss of income, including loss of earning capacity
  • Property damage, including items in the car that were damaged in the crash (i.e. laptop, cell phone, etc.)
  • Physical pain and emotional suffering
  • Other out-of-pocket expenses

A Fresno car accident attorney can help you determine if you are entitled to receive compensation. He can also help you prove that the other driver is at fault for the accident.
