An unclothed man on foot was killed by a big rig on Highway 99 in Fresno on Wednesday, the California Highway Patrol said. A caller reported the collision to authorities at about 4:10 a.m. along Highway 99 close to McKinley Avenue before a second caller reported he had been struck three minutes later, CHP said.

According to authorities, a trucker in a Peterbilt big rig was going north in the slow lane as the pedestrian walked in that lane. The driver swerved to avoid striking the walker but could not avoid the fatal Fresno big rig accident with the pedestrian, CHP said. The man was thrown to the eastern shoulder of the highway and was pronounced dead at the scene. An investigation is being conducted by the CHP to determine what happened and to assign fault.

Understanding Wrongful Death After a Fresno Big Rig Accident

A wrongful death occurs when a person’s life is ended due to the negligent actions or intentional misconduct of another party. This can happen in various situations, including traffic accidents and the use of unsafe products. For a death to be legally deemed wrongful, it must result from someone else’s failure to act responsibly or deliberate harmful acts.

Who Can File a Wrongful Death Lawsuit

The immediate family members of an individual who died in a Fresno big rig accident, such as the spouse and children, are the primary individuals eligible to initiate a wrongful death lawsuit. In cases with no surviving spouse or children, the rights extend to the deceased’s parents and siblings. Furthermore, the estate’s administrator can file the lawsuit if there is a will. Since only one claim is allowed, it is necessary to determine how any awarded benefits from the wrongful death lawsuit will be distributed.

Recoverable Compensation in a California Wrongful Death Claim

In a California claim for wrongful death, various types of recoverable compensation may be available to the deceased’s family members after a Fresno big rig accident. These typically include:

  • Funeral and cremation or burial costs
  • Loss of financial support that the deceased would have contributed
  • Loss of gifts or benefits that might have been expected from the deceased
  • The value of household services that the deceased would have provided
  • Loss of companionship, love, and moral support
  • Loss of guidance and training for surviving children

Understanding the Timeframe for Filing a Wrongful Death Claim

When a loved one is lost due to a Fresno big rig accident, it is crucial to file a wrongful death claim within two years of the accident. Missing this statute of limitations could result in the court dismissing the case. Engaging a wrongful death lawyer can be a valuable step in this process. An attorney can handle all aspects of the claim, including negotiations with the liable party’s insurance, allowing grieving families to focus on healing without legal complexities.
