Fresno Authorities Seek Hit-and-Run Driver

Torem & Associates

Fresno authorities are searching for a hit-and-run driver who killed a homeless man on March 30. The accident happened around 1:00 a.m. close to the transition for highways 41 and 180 when a Range Rover exited the roadway and struck the man in his makeshift home in a bush, according to the California Highway Patrol (CHP). The man who was struck, identified as Ervin Price, 49, died at the scene.

Authorities Know Who the Hit-and-Run Driver Is

Family members were devastated when the man’s daughter received a call around 7:45 a.m. from the County Sheriff’s Office, telling them of the death. The daughter hopes the driver who fled the scene will turn himself in. A GoFundMe site has been set up to help with expenses.

Determining the Cause of an Accident Involving Multiple Vehicles

An accident lawyer has the resources and experience to determine fault in an accident. This is especially important if a wrongful death occurs. If negligence by another motorist was the cause or a hit-and-run driver was involved and located, the family may want to file a wrongful death claim to recover damages. Recoverable compensation includes:

  • Wages the decedent would have earned until retirement
  • Funeral and burial or cremation expenses
  • Loss of consortium for the surviving spouse, as well as the affection and moral support the decedent provided
  • Loss of guidance and nurturing for the family’s children
  • Loss of household assistance, which includes areas where the decedent did regular chores

Who Can File a Wrongful Death Claim

The immediate family members can file a wrongful death claim if the hit-and-run driver is found. By immediate family, it refers to the spouse and children. However, the estate administrator also has the right to file. Only one claim is allowed. The siblings and parents may file a claim if the decedent had no children or spouse.

When Should My Family File Our Claim?

Personal injury cases in California have a two-year time limit to file a wrongful death claim. This is called the statute of limitations. Although you can wait until later, filing as soon as possible can produce a more successful outcome. Waiting too long means that witnesses can move away, and evidence can disappear. By filing a claim, the grieving family cannot only avoid financial distress caused by the sudden demise of a loved one but can receive justice for their loss and a sense of closure.
